我国文博领域法治体系建构初探

Preliminary Study on the Rule of Law System in China's Cultural Heritage Field

中国特色社会主义法治体系正在形成之中,作为其重要的子体系之一,我国文博领域也当以完备的法律规范体系、高效的法治实施体系、严密的法治监督体系、有力的法治保障体系、完善的行业自律规制体系为支撑,构建自身的法治体系。虽然文博行业这样的体系正在建构,但是依然有诸多问题亟待解决,诸如:违规违法行政责任追究、公众参与机制、文博执法地位的增强、执法过程与结果的透明、第三方及公众监督、高效的惩治机制、防止惰政无为的自律规制等等。

While the socialist rule of law with Chinese characteristics is in forming in the country, it is time for the cultural heritage field to construct its own system of rule of law realized through the shaping of a perfected system of legal norms, a highly effective system to implement the rule of law, a strict system for rule of law supervision, a powerful system of rule of law guarantee, and a sophisticated self-regulating sys- tem. In doing so, a range of problems remain to be solved concerning the accountability of illegal conducts, the mechanism for public participation, the status of heritage administrations to enforce the law, the transpar- ency of the law enforcement, the third-party and public supervision, the punishment of law breakers, the self-regulating mechanism to prevent the lack of action.
