The System View and Construction Path of Preemptive Right——In the perspective of tenants' preemptive right as demonstration model

优先购买权是民法的一项重要制度,在社会经济生活中发挥着重要规制作用。然而,我国现行法律对优先购买权的规定存在立法规定不统一、规定缺乏实务操作性、适用范围尚有待于扩展等诸多缺陷,其严重制约了优先购买权制度应有立法价值取向的实现。因此,从明确优先购买权在民法中的定位、完善优先购买权的一般性规定、增加优先购买权的类型等方面进行完善是较为可行的。

The preemptive rights is a vital system in civil law and it plays an important role in social and economic life. However,there are many defects in its legal provisions such as its non-uniform legislation, non-operational provisions and narrow scope which restrict severely its function. Therefore, it＇s necessary to improve and perfect this right through the way of giving priority to it in the civil law, improving its general pro- visions.
