夫妻一方对外举债的若干法律问题探析——以刘某诉阎某、苏某借贷纠纷案为例

Legal Issues of the Spouses of Foreign Borrowing on the Marrzage Relationship

关于婚姻关系存续期间,夫妻一方以个人名义对外举债的认定,在实际案例的处理过程中,存在诸多争议。这主要涉及三个方面的法律问题:借款真实性的考察、债务性质的认定,举证责任的分配等。在具体案件的处理中,需结合案件实际情况,首先辨明借款的真实性,是否存在虚构债权债务关系,隐藏、转移财产的情况,在此基础上认定债务性质,是属于夫妻共同债务还是一方个人债务,判断适格的当事人,合理分配举证责任。

During the existence of marriage relationship, the spouses of foreign borrowing as an individual identified in the process of actual cases, there is a lot of controversy. Which mainly involves legal issues in three areas： the borrower finds study, the nature of the authenticity of the debt, the burden of proof allocation of responsibilities and so on. In dealing with spe- cific cases, the need to combine the actual situation of the case, the first to identify the authenticity of the loan or not, the existence of fictitious claims and liabilities, hide, case transfer of property, identified on the basis of the nature of the debt, or the debt belongs jointly one personal debt, determine eligibility of the parties, a reasonable allocation of the bur- den of proof.
