审判人员违法行为检察建议系民事诉讼法新增的检察监督方式,弥补了民事审判检察监督制度的巨大空白,但存在着"可操作性不强"的通病,应当从明晰监督对象和健全监督程序两个方面予以完善。在监督对象方面,一是审判人员,包括审理本案的人员、辅助人员以及领导人员;二是民事审判程序,包括诉讼程序和非讼程序;三是违法行为,主要包括程序违法行为,也包括部分实体违法行为。在监督程序方面,应当设立人民法院的纠错程序,完善人民检察院提出检察建议的程序和权力制衡程序。
