摘要
醉酒型危险驾驶罪是公众所关注的案件,实现量刑的公正、均衡非常重要。但由于该罪立法上的特点,导致在司法工作中量刑出现畸轻畸重的情况。因此,实现该罪的量刑规范化非常必要。应合理设置该罪的量刑基点、基准刑,并适当确定从重、从轻情节。
Drunken-type crime of dangerous driving case is of public concern. It is important to achieve a just,balanced sentence. However,due to the characteristics of the crime legislation,it appears injustice. Therefore,the realization of the crime sentencing standardization is necessary.
