Jurisprudential Thought of Malicious Speculation of Prison’s Innovative Measure

二十世纪末期以来，媒体对监狱推行的系列创新性举措，包括亲情同居、回家探亲、实施开放日等等的炒作十分严重，这客观将监狱工作推向了想创新而不敢创新的尴尬境地。通过梳理分析炒作的主要事件，这与监狱内外对监狱执行刑罚的“法与理”不太清楚、理解不一存有极大关系。因此，立足新的时代背景，对监狱行刑的法理继续进行深层次的揭示与解析就显得非常重要与紧迫。

Since late 20st century, media has given too much malicious speculation to Prison’s various innovative measures including family living together, going home visiting families, and carrying out open day. Through detailed analysis, there exists ambiguous understanding of law and reason. Therefore, based on new era background, it is very important and urgent to take a probe into the legal principle of prison execution.
