The Conflict and Balance between Rights and Powers in the Light of Rule of Law

权利与权力的关系问题是法学中的基本问题,包含着丰富内容,是法治现代化不可不面对的问题。随着社会经济的发展,传统与现代、城市与乡村、公民个体与国家机器之间的矛盾不断凸显,在中国转型期更带有中国语境,呈现出不同的特点。法律规范作为法治现代化的重要标志,权利与权力在其中各自发挥着不可忽视的作用,但是也面临着紧张关系,权力的良好运行与权利受到充分保障之间似乎难以维持平衡关系。

Right and power are fundamental questions of legal studies. They are meaningful questions that we must face in our country＇s construction of ruling of law. With the development of society and economy, the contradictions between tradition and modern, city and country, civil and state are arising, which are different especially in China＇s revolution period. Ruling of law is the symbol of a country＇s modernization, the right and power are mental, are paradoxical sometimes likely giving us a side that they are not harmonies at work. So, we should pay attention to the relationship between the right and power.
