摘要
诉调对接纠纷解决机制是一种在确保人民法院履行依法裁判职责的基础上、在诉前分流部分案件至非诉机构、以充分发挥非诉渠道解决纠纷的功能、建立诉讼与调解相互衔接的工作机制。本文通过对S省P县法院的诉调对接纠纷解决机制试点运行情况进行深入实证调研,分析诉调对接纠纷解决机制存在的问题和原因,并提出了加强法院的指导、对案件进行类型化调解、创新工作机制等完善诉调对接机制的建议。
In order to deepen litigation and conciliation dispute resolution mechanism, a new form of the people's courts participating in social management innovation should be explored. Therefore, giving full play to the function of settling disputes of tt^e people's cou^-ts on the basis of ensuring them to perform their duty to legally resolve disputes. This thesis empirically dwells on the operating dispute resolution mechanism of docking litigation and conciliation practicing in the courts of P court of S province, offering an analysis of the problems and causes of the existing in the dispute resolution of docking litigation and conciliation. And some adviees on how to improve the operating resolution dispute mechanism of docking litigation and conciliation are aslo given.
