摘要
为了分析国际水条约对我国西南地区国际河流开发与保护的影响,对我国与西南国际河流相关国家签订的主要法律、条约以及下湄公河流域主要管理机构进行了系统的梳理,分析了各条约对我国水能开发可能产生的影响,明确了我国享有的权力和利益以及相关限制和所需承担的义务。在此基础上,提出了对相关影响可采取的对策,可供我国与相关国家进行磋商和谈判作为参考。
In order to analyze the influence of international water treaty on the development and protection of the international rivers in southwest China, the main laws and treaties signed between China and the countries involved in the international rivers as well as the management agencies in the lower Mekong Basin were systematically summarized, and the influence of the various treaties on the hydropower development in China were analyzed; meanwhile, the rights and interests, the relevant limits and required obligations of China were defined. On this basis, the possible countermeasures were analyzed to provide technical support and scientific basis for the consultations and negotiations between China and the relevant countries.
