英国巡回法庭制度的启示与借鉴

Inspiration and Reference from British Circuit Court System

巡回法庭制度起源于英国.在世界范围内,各国学者大都以英国的巡回法庭制度作为研究对象。英国巡回法庭制度的成功实施,加强了中央集权,维护了司法统一,吸收了地方习惯法,削弱了地方势力,为英国以普通法为主的现代司法体系的形成起到了重要作用。我国司法目前饱受"行政化"和"地方化"的困扰,司法权的统一性、系统性难以在地方上有效实施。借鉴英国巡回法庭制度的经验,在我国巡回法庭成立的初期阶段,也不失为一个明智的选择。

The circuit court system originated in Britain and scholars of the world mostly take the British system as their object of study. The successful practice of the British circuit court system strengthened the central authority,maintained judicial unity,absorbed local customary laws,weakened local forces,and are significantly contributory to the formation of Britain's modern judicial system with the common law as its main content. In China,jurisdiction is heavily bothered by'administration'and'localization';judicial unity and systemization can hardly be effectively implemented in local areas. At the initial stage of China's circuit court system,it is wise to learn from the British experience.
