摘要
当前农村宅基地管理中存在"一户多宅"现象严重、宅基地超占比例过高、新村建不好、老庄拆不掉、宅基地使用对象和功能变化等问题。宅基地用益物权作为农民财产权利的重要组成部分,却没给农民带来财产性收益,其根本原因在于农村宅基地使用管理制约了宅基地流通的功能。文章以江苏省为例,从宅基地日常管理中遇到的实际问题入手,从有利于新农村建设的角度,在"户"的概念、农民身份确定,建立宅基地的法定面积标准、超占用地如何处理、如何引导农民跨村组用地等方面提出了具可操作性的对策与措施。
There are several commonproblems in the current management of rural homestead as follows.The pheromone of 'one household, multiple housing lands' is very serious, the proportion of over-occupying homesteadis too high, new villages are not wellbuilt while old villages are hard to remove, and the objects and functionsof homesteadchange a lot. Homesteadbrings no property income to farmers, while theusufructuary right of homestead is an important part of farmers' property. The fundamental reason is thatthe rural homesteadmanagementsystem restrictshomestead circulation. Taking Jiangsu Province as an example, we carry out workablecountermeasures on determining the concept of 'family' and the identity of the farmers, establishing legal standards of homestead, how to deal withover-occupying homesteadand how to instruct farmers to use land cross-village, aiming at solving the practical problems encountered in the daily homestead management and promoting new rural construction.
