网络转载“新规”对国家话语体系建设的意义——以著作权保护的法治理性为视角

国家版权局发布《关于规范网络转载版权秩序的通知》,要求互联网媒体转载作品须经授权并付酬,文字性修改不得歪曲篡改,并指明《著作权法》关于纸媒互相转载无需授权的规定不适用于互联网媒体,同时,还将具有"独创性劳动"的"时事新闻"也纳入著作权法保护的范围。"新规"若法制化并有效实施,必将激发作者知识、思想的创造力,增强传统媒体在网络时代的话语权,促进网络媒体规范高质发展,塑造理性讨论的舆论场。而这一切都将对国家话语体系建设和知识产权战略实施起到重大推动作用。
