农地非农化中利益主体博弈行为逻辑分析——以失地农民与地方政府为例

A Logical Analysis of Game Behaviors of Stakeholders in Non-agricultural Conversion of Farmland: With Land-Loss Farmers and Their Local Governments as Examples

应用模型分析法和制度分析法,研究了失地农民与地方政府在农地非农化过程中的利益关系,从博弈论角度探析失地农民权益受损的原因和依法维权的内在机理。应规范地方政府施政行为,强化权利监督约束机制;搭建多渠道诉求平台,降低维权成本促稳定;科学分配农地增值收益,健全农村社保就业体系;健全土地法律法规,创新农地产权制度等路径来确保失地农民权益,从而促使处于劣势地位的失地农民在与地方政府博弈过程中,权益更加趋于合理均衡。

Adopting the model analysis and institutional one to study the benefit relationship between land-loss farmers and their local governments in the process of non-agricultural conversion of farmland, the paper explores the reasons for the interest damage of land-loss farmers and the internal mechanism for safeguarding their legal rights. The administrative behaviors of local governments are supposed to be regularized to strengthen the super- visory and restraining mechanisms for rights. A multi-channel appealing platform is expected to be constructed to lower the cost of safeguarding rights and promote stability. The value-added income of farmland should be alloca- ted scientifically to improve the rural social security and employment systems. And such approaches as develo- ping the land law and regulation as well as innovating the system of farmland property rights and so on are recom- mended to ensure the rights and interests of land-loss farmers so as to secure the more reasonable and balanced rights and interests for the disadvantageous land-loss farmers in the game with their local governments.
