Construction of a Hearing System in Criminal Judicial Psychiatric Appraisal

在刑事诉讼中司法精神病鉴定对当事人的诉讼行为能力的确定具有重要意义,其直接决定了当事人的诉讼资格,涉及当事人利益,影响刑事案件的进程。然而,目前我国刑事司法精神病鉴定程序中鉴定的启动、参与人员、程序规范等方面存在诸多问题。为消解以上症结,应当将具有公开、公平和公正的听证程序引入该领域,从而保证司法精神病鉴定意见的作出更为理性。

Judicial psychiatric appraisal is of great significance to the legal capacity of the parties in criminal proceedings, which directly determines the qualification of litigants, involves the interests of the parties and af- fects the process of criminal cases. However, many problems exist in start of appraisal, participants and proce- dural norms and so on in the procedure of current criminal judicial psychiatric appraisal in China. In order to solve these cruxes, it is suggested to introduce an open, fair and impartial hearing system, ensuring a more rea- sonable opinion made from judicial psychiatric appraisal.
