关于山东省食品安全犯罪问题的调查与思考

摘要 食品安全犯罪具有案件数量急剧上升、涉案人员整体文化水平不高、涉及食品类型多样、生产场所隐蔽等主要特征。追求低成本高利润的逐利心理、原法律框架下监管部门之间未形成工作合力、市场规制本身的局限性、食品供应者文化层次低、社会公众的食品安全意识欠缺等是食品安全犯罪的主要原因。根本解决食品安全犯罪问题须从严密刑罚治理体系、完善行政规制体系、提高刑事和行政执行力、发挥民事规制的补充作用、强化道德规范引导等方面构建食品安全综合治理体系。 Food safety crime is characterized by sharply increasing number, low education level of those involved, a variety of food being involved, and hidden production places. Pursuit of low--cost high--profit profit--seeking psychology, no joint effort formed between regulators under the original legal framework, the limitations of market regulation itself, low level edu- cation of food suppliers and the lack of social public food safety awareness are the major causes of food safety crimes. To solve the problem of food safety crime, we must construct a comprehensive management system for food safety in terms of rigorous punishment management system, perfect the administrative regulation system, improving the criminal and administrative execution, playing a role of supplementary civil regulation, strengthening ethics guidance, etc.
