司法行政化研究——以审判管理与人事管理为视角 被引量:2

摘要 司法行政化与司法地方化为阻挠依法独立公正行使审判权的两大痼疾。司法行政化是指以行政的方式操作司法。司法异于行政,在价值与权力结构之间存在着重大差异。以行政方式操作司法会挤压司法资源,违背司法规律,损害司法权威,压缩司法空间。文章拟以审判管理与人事管理为切入点,深描行政渗透司法并挤占司法资源;其次,从司法行政化特有的权力结构根源以及历史根源分析司法行政化的产生及发展;最后为顺应司法改革的大潮流,司法去行政化可采取诸如分类管理、加强司法人员的保护机制以及优化审判管理制度等措施。 The judicial administration and judic ial localization have became stubborn obstacles in achieving the independence and impartial implementation of the judicial authority for a long time. The judicial administration means to operate the judicial system by means of administrative method. Judiciary significantly differs from administration in the structure between value and power. To operate the judicial system by means of administrative method will squeeze the judicial resource, violate the law of legal system, weaken the judicial authority and narrow the judicial space. This paper intends to take the trial management and personnel management as the starting point to describe the judicial system and judicial resources penetrated and squeezed by administration. Secondly, through analyzing the sources of power structure and history characterized in judicial administration, the existence and development of judicial administration will be described. Finally, following the general trend for the judicial reform, measures such as category management, strengthening the protection mechanisms of judicial personnel and optimizing trial management system should be implemented to avoid the judicial administration.
