摘要
个人非恶意原因造成的负面信用记录给金融消费者带来不利影响的同时,也容易导致金融消费者、数据报送机构和基层人民银行之间产生矛盾和纠纷,引发诉讼风险和法律风险。结合苏皖鲁豫交会地带7个地级市基层人民银行的征信业务实践,分析非恶意个人负面信用记录的成因和风险,建议履行告知义务,适当宽限展期,强化征信模块,以逐步减少个人负面信用记录纠纷,不断提高基层人民银行征信业务服务水平。
Negative credit record resulted from personal non-malicious causes not only have unbeneficial impact on the financial consumers, but also are vulnerable to generate conflicts and disputes among financial consumers, the data-submitting agencies and the grass-rooted branches of the People' s Bank of China (PBC), and cause litigation risks and legal risks. Based on the credit reference practices of the grass-rooted branches of the PBC in seven prefec- ture-level cities in the border region of Jiangsu, Anhui, Shandong and Henan province, the paper makes an analysis on the causes and risks for non-malicious personal negative credit record, and suggests that the fulfillment of notifica- tion obligation, appropriately extending grace period, and strengthening credit reference modules be required to gradually reduce the negative personal credit record disputes and constantly improve the credit reference services of the grass-rooted branches of the PBC.
