法制视角下我国数字版权保护问题研究

数字出版是我国出版行业的发展趋势,在数字化的背景下,如何保护我国数字出版版权是亟待解决的问题。就数字出版版权的法律属性而言,其是公民的政治权利,具有一定的主体属性。目前,我国数字版权保护方面存在法律意识淡薄、立法不完善、法律制度上有缺陷等问题。同时数字作品自身的特殊性不利于版权保护。随着我国数字版权侵权行为日益泛滥,加强我国数字版权保护的法制建设尤为重要。因此,必须立足我国数字出版行业的现实发展状况,不断完善我国数字版权法律制度,打造公正、平等的数字版权法制保护平台,完善我国数字侵权法律监督体系,完善我国数字出版侵权救济途径,从法制角度着力解决我国数字版权保护问题。

Digital publishing is the development trend of China＇ s publishing industry in the digital context.Therefore,how to protect the copyright of digital publishing is a serious problem. The legal property of digital publishing copyright,its political rights of citizens,displays a certain subject attribute. Currently,problems like digital copyright protection of legal awareness,inadequate legislation,the legal system defects and other issues,together with the particularity of digital works itself are not conducive to copyright protection. With the growing proliferation of digital copyright infringement,to strengthen our legal system of digital copyright protection is particularly important. To solve the problems,attention should be paid to the reality of China＇ s digital publishing industry,and constantly improving the legal system of digital rights,creating a fair and equitable legal system of digital copyright protection platform,improving our legal system of supervision and digital piracy,and our way of digital publishing tort relief from the legal system angle efforts.
