摘要
事实劳动关系的研究一向是劳动法研究的重要领域,就其界限认定的问题,理应置于理论和实务的两个面向展开。排除无效说的同时应确定事实劳动关系作为概念的具体范围。针对两个最高人民法院答复的研究,发现应在法律解释的角度关注事实劳动关系认定的界限问题,而扩张概念的深层原因在于事实劳动关系的救济性,或是劳动关系之外的救济困难。最后得出结论,为避免概念和体系的混乱,扩大社会保障范围或设计新的保障体系。
The study on the limitation of factual labor relations always takes over the core area of labor law. The problem of identify should launch in theoretical and practical areas. We should reject the invalid theory and ensure the range of concept.Aim at two answers made by Supreme Court,we found that we should take interpretation direction then pay attention to this problem. The expansion of interpretation comes from the relief quality of factual labor relations,or the difficulty of relief in non- labor relations. In the last,there are two ways to avoid the chaos of concept and system,expand the social security or design the new security system.
