摘要
领导干部干预司法的主体应涵盖国家机关中的公职人员,客观上意味着司法干预者利用权力影响案件承办人,以达致于己有利的法律后果。主观上则在于,领导干部希望通过自身干预而达到受益效果。防控领导干部干预司法面临着诸多困境,包括历史传统和"党管政法"的现实背景、干预记录制度实施困难、监督权力配置失衡三个方面。建立领导干部干预司法防控制度,则应考虑改进党对政法工作的领导方式,同时多项司法改革措施并举。
The subject of leading cadres who interfere with the judicial activity should cover government offices,army and civil association. On the objective aspect,intervenors always look forward to achieve his goal by the means of power. Subjectively,the leading cadres are expected to benefit from the intervention. To prevent and control the interference of leading cadres to the judicial activity has faced with numerous predicaments,which include the different historical traditions and the realistic background of "Party governs the politics and law",the difficulty on the implementation of the interference-recording system,and the unbalance of allocation of the supervisory authority. There are two methods could be adopted in order to establish the preventing and controlling system of the interference of leading cadres to the judicial activity: improving the way of leading law,and implementing other supporting measures of judicial reform.
