法意与神袛:基于《叫魂》所反映的法律信仰空间的探讨

The Connotation of Law and the Supernatural Being: the Discussion of Faith-based Legal Space Based on Soul Stealers

法律史学界一直非常关注中国传统法的传承与创新。《叫魂》的刊布,使得中国古代法律传统与当代法律历史遗存有了空间范畴上的会通之处。此书甫经出版,即获众多推介。后续相关研究成果虽丰,但甚少有从法律信仰的角度来解构彼时法律架构的意涵。叫魂案中,民众对神袛幽冥的信仰,官员对皇帝权力的信仰,二者汇聚所形成的两种虚实重叠的权力对冲和交锋,有助于省思传统权力与信仰的真实图景。再度追索叫魂案传衍的历程,它的实质价值在于分层权力网格中人物所呈现的法律信仰主体与归途的差异。以书为镜,透过观照内在性结构中权力与信仰的不同面向,不仅可以发掘传统皇权社会中法律的历史惯性问题,更可以借以寻觅根植于传统中国内部甚至延续至今的法律信仰空间问题。

Legal historians have been very concerned about the inheritance and innovation of traditional Chinese law. The publication of Soul Stealers made the ancient Chinese legal traditions and contemporary legal remains integrated at space. Since this book was published,numerous recommendations came out. Though there are lots of follow-up researches,few people interpreted the law framework from a legal belief perspective. In the case of Soul Stealers,people＇s belief in God and ghosts,as well as the official＇s conviction in imperial power,are combined to form the hedge and clash of power,which helped to think about the traditional power and faith. When recalling the Soul Stealers,its real value lies in the differences in the subjects＇ legal belief and directions. With the book as a mirror,through the contemplation of the inner structure of the different aspects of power and faith,not only can we explore the historical inertia problem with traditional imperial society of law,but also find a traditional Chinese belief space issues rooted in the traditional Chinese law.
