论边疆治理现代化视角下陆疆口岸驻地的行政建制设置

On the Setting of the Administrative Organizational System in Land Ports in the View of the Frontier Governance Modernization

近年来,受自然地理、国家战略、经济社会发展、法律制度及邻国关系等因素影响,陆疆口岸驻地的行政建制设置遭遇到地方经济冲动与国家安全战略的冲突、地方权限与多头管理的体制制约、经验借鉴与地方实际的水土不服及"事实合理"与"法理违背"的矛盾等难题。要促进边疆治理体制与治理能力现代化,提升边疆口岸驻地政府的治理能力,必须完善相关法律,理顺体制机制,因地制宜,分类设置,特别是应减少准行政建制,推进行政特区建制。

In recently years,there are so many troubles such as the conflicts between the local economic development and the state strategy,the local power and the central authority,the local case and the external experience,the reasonable behavior and the legal violation,because of the special geography,the state strategy,the economic and social development,the law system and the foreign relationship.In order to improve the modernization of state governance system and ability,the basic setting measures of the administrative organizational system in land ports are classifying and setting according to local conditions,selectively reducing quasi- administrative organizational system,and expanding the scope of application of special administrative organizational system by perfecting related laws and political systems.
