摘要
公物作为行政的物的手段,已经日益成为给付行政的重要一环。现实中公物的功能被异化,滥用的权力侵蚀了公物本来所承载的公共利益。特别使用是超出公物本来使用目的的一种利用,这种使用由于已经超出了公物公共用途的范围,在现实中极易造成对公物的一般使用的妨害,甚至损害到社会公共利益。本文以道路停车泊位施划为例证,对公物的特别使用及其许可权的规范与控制进行研究,以期能够对现实问题的解决提供新的思路。
As a kind of subject matter whereby administrative activities are carried out, public property has increasingly formed an important part of the administrative payments. In the reality, however, the function of public property is distorted and the abuse of public power is eroding the public interest reflected in public property. The special usage of public property is utilization beyond its original purpose. As such special usage exceeds the scope of the public purpose designed for public property, it is very likely to impede the normal usage of public property and even impair public interest of the whole society. This article, based on a case study of road parking planning, analyzes the special usage of public property as well as the normalization and restrictive control of the licensing power for such special usage, in an effort to provide a new way of thinking that could help to solve the above - mentioned problem.
