村官腐败原因探析及其规制

村官腐败现象与农村改革有着密切的关系,以农村改革进程为主线,改革的不同阶段,相应的村官腐败规模不同,体现出鲜明的时代特征。农村改革打破原有乡村道德体系,提高了腐败的动机;打破原有制度体系,权力缺乏有效监督,为腐败提供了机会;法制不健全导致执行力缺失,导致制度约束力羸弱。法律制度作为制度体系中最为正式的制度之一,对反腐败具有极其重要的意义,村官腐败涉及贪污贿赂类问题,单纯刑法不能有效遏制腐败问题,严厉刑罚惩处村官腐败的"重典治世"思想不可取,分析村官腐败的成因对症下药,方能药到病除。

Only anaiysis of the causes of the village official corruption is proper remedy.
