On the Dual Task and Route Selection about Network Public Space Governance

治理网络公共空间面临保护言论自由和规制网络失范行为的双重任务。基于自由与秩序的原理和平衡论思想与理论的指导,要达成治理网络公共空间的目标、实现网络社会法治化,就必须突破单边主义的思维方式与行动逻辑;努力实现规制网络失范行为与保护公民言论自由的衡平,达成网络共识,是实现网络社会法治化治理目标的一种进路选择。

During governing network public space, we are facing with dual tasks, that is, protecting freedom of expression and regulating network anomie behavior. Based on the principle of freedom and order and balance theory, we must break through the unilateral mode of thinking and action in order to bring the governance of network public space under the rule of law. We have only one kind of route choice. That is to say, that we have to regulate network anomie behavior and protect citizens＇ freedom of speech equally, and reach consensus on the network, for realizing the objective of the network society under the rule of law.
