绿色技术产业化与专利制度创新问题初探

Study on Innovation of Patent System in the Industrialization of Green Technology

为实现我国经济更好更快、可持续发展,积极承担应对全球气候变化的国际义务,推广绿色技术、推进绿色技术产业化已是大势所趋。毋庸置疑,知识产权制度,尤其是专利制度是绿色技术研发、推广及产业化的制度保障。然而从实践来看,我国现行专利制度并没能满足为绿色技术产业化保驾护航的需求,相反却可能成为绿色技术发展与应用的障碍之一。绿色技术专利申请大量积压,绿色技术专利质量不佳,专利闲置率高、转化率低等现实因素都严重影响着绿色技术的产业化发展。在环境污染、全球气候变化的大背景下,推进绿色技术产业化发展已刻不容缓,现行专利制度要从以上问题出发加以完善才能真正发挥其制度保障作用,绿色技术产业化繁荣发展的景象才有望呈现。

For the better and sustainable development of economy and undertaking the international duty to protect the environment, it has already represented the general trend to energetically promote the green technology and develop low carbon economy. There is no doubt that the intellectual property system, especially the patent system, provide system security for the green technology and it is industrialization. However, in terms of the reality, the patent system doesn＇t stimulate the development and industrialization of the green technology, to some extent, it give negative influence on the development of green technology .Low quality, low utilization ratio of the green technology adversely influence the industrialization of the green technology. So it is necessary for us to make reasonable innovation for the patent system currently in force. Only in this way can we achieve the goal to prompt the development and industrialization of green technology.
