Balance between Network Regulation and Freedom

网络因其技术性特征内嵌了自由的天然属性,人们在享受网络空间的自由和便利时也导致自由的异化,而政府的规制又存在公权力滥用导致自由权益损耗的现实风险。理性选择网络空间的规制模式,应综合运用网络法治治理、行业自律和文化引领的规制策略,明确政府的网络规制权力边界以及网络主体的权利义务,清晰地设定程序要求,发挥行业组织的自律自治功能,强化网络文化的引领与导向,在网络自由与规制之间不断调整平衡支点,通过法治视野下的网络有限规制保障网络主体的合法权益。

Network has its embedded nature of freedom because of its technical characteristics.While being enjoyed,this kind of freedom suffers from alienation.While being regulated by the government,it may run the risk of being limited too much due to the potential abuse of public power.Therefore,it is necessary to rationally choose the mode of cyberspace regulation,find a balance between network freedom and regulation,and protect the legal rights of cyber subjects through lawful regulations.
