摘要
在关于民事诉讼法律关系理论的各种学说中,德国新诉讼法律关系学说目前较为科学。应借鉴德国新诉讼法律关系说对我国民事诉讼法律关系理论进行重新构建,特别是应根据德国新诉讼法律关系说的诉讼负担概念,重新界定我国当事人的诉讼义务。
Among all the legal relationship theories of civil procedure,the new litigation legal relationship theory in Germany is more scientific at present. We should reconstruct the legal relation theory in civil procedure law in China with the reference of the new litigation legal relationship theory in Germany,especially the concept of litigation burden,and redefine the litigation obligations of the parties in China.
