摘要
TPP协定具有"全覆盖"与"高标准"两大特点,其重要的标志之一就是纳入严格的劳工标准。劳工标准纳入全球贸易规则是一个必然趋势。中国与TPP劳工标准方面的主要差距,不仅在于劳工标准内容方面的不完整,而且在于中国缺乏对劳工规则的执行机制,以及劳工问题的争端解决机制上。TPP劳工标准对中国劳动关系的影响是潜在、复杂而多元的。一旦TPP生效,贸易转移效应等因素会对经济、产业和企业,进而对劳动者构成负面影响,劳动法和外贸规则修改和完善的紧迫性凸显,企业的法定义务和社会责任会得到强化,劳动争议的性质和处理方式会发生变化。我们应该在思想观念和政策取向上,应该变回避为直面,建立与国家战略相匹配的组织领导体系和研究队伍;在劳动标准领域,促进科学立法、严格执法;完善国际化情境下的劳动关系协调机制。
The TPP agreement is characterized by complete coverage and high standard. One of the important labels is the inclusion of stringent labour standard, which is a inexorable trend. The main gap between Chinese labour standard and that in TPP lies not only in incomplete contents of the standards, but also with the respect of lack of executive mechanism of labour regulations as well as labour disputes resolutions.The impact of TTP upon Chinese labour standard is latent, complex and divergent.Once the enactment of TPP, the transferring effect of the trade will negatively influence economy, industry and enterprises as well as workers' interests. Consequently, the amendment over labour laws and export regulation will become more urgent; the legal obligations and social responsibility of the enterprise could be reinforced; and the labour dispute resolution can be optimized. The direction of the policy-making should be more closely related to TPP rather than avoiding it. By so doing, special team can be formed in order to promote labour standard, scientific legislation, strict implementation as well as coordination of labour relations.
