Labor Dispute Mediation Linkage Mechanism and Its Reflection

摘要 劳动争议联动调解机制是指国家基于劳动争议多发化、群体化的维稳压力,运用政策手段,对多元化、社会化的调解机制实施国家统合的结果。该机制整合不同调解资源,形成调解合力,在一定程度上实现了对劳动争议的控制。但是由于过度追求维稳功能、以国家代社会,损害了调解的本质属性,模糊了不同调解机制的界限,阻滞了国家与社会并治的多元劳动解纷模式的建构。矫正该机制的不足,应坚守开放式、社会化、多元化的基准思路,坚持国家与社会二分的解纷思维,着重加强调解机制的规范化、法制化建设,着力培育民间调解机制的权威基础。在此基础上,秉持"多元、效能、竞争、开放"的原则,针对不同调解机制的特点和不足,采取具体化对策,做强做大劳动调解体系。 The linkage mechanism of labor dispute linkage mediation is based on the pressure of multiple and mass labor disputes, and the lack effectiveness of the social mediation system, to take a national construction strategy for the diversification and socialization of the mediation mechanism. The logic of excessive emphasis on maintenance of stability of mediation, the implementation of national integration and of the state instead of the society, damages to the nature of mediation, confuses the boundaries of different mediation mechanisms, blocks to the construction of multiple labor dispute pattern of governance of the state and society .Correction of integration logic, should adhere to open, socialized, diversified benchmark ideas, adhere to both the state and society dispute resolution thinking, strengthen the standardization and legalization of the mediation mechanism, efforts to cultivate the social authority of civil mediation mechanism. On the basis of this, should uphold the principle of "pluralism, efficiency, competition and opening-up", according to the characteristics and shortcomings of different mediation mechanisms, and take concrete measures to make them stronger and bigger
