国家赔偿风险的保险转移机制初探

A Preliminary Study on the Transfer of Government Liability Risk by Insurance Mechanism

国家赔偿制度是保护公民权利的基本法律制度。在当前依法治国大背景下,《国家赔偿法》和相关法律体系确立的国家赔偿责任风险管理机制已经严重滞后于时代需要,本文对将保险机制引入国家赔偿制度,进行了可行性和必要性分析,并对国家赔偿责任保险的运行模式、归责原则和责任分层进行了初步设计。

National compensation system is a basic legal system to protect the rights of citizens.In the context of the current law,＂the state compensation law＂and related legal system established by the state compensation liability risk management mechanism is seriously lagging.This paper introduces the insurance mechanism into national compensation system,analyzing its feasibility and necessity.The operational mode of liability insurance,imputation principle and responsibility stratification of national compensation are all preliminarily designed.
