摘要
"小饭桌"已遍布我国大陆城区,其首要功能是保证就餐学生的食品安全。当前"小饭桌"大多无证经营,环境卫生差、食品安全无保证,建议尽快出台全国层面专门的"学生小饭桌食品安全监督管理"立法,构建起"小饭桌"食品安全事前预防、事中监督管理及事后奖惩三大法律保障机制,并设计相应具体制度。必须对"小饭桌"经营者加强法制宣传教育、加强"小饭桌"食品安全政府日常监管、提高"小饭桌"学生及其家长的食品安全意识与法律维权能力以及强化"小饭桌"食品安全社会监督机制,以确保整套机制发挥实效。
"Small table" has been popular in cities of China's Mainland, its primary function is to ensure students' tood safety meal. Current "small table" are mostly unlicensed, poor sanitations, and food safety is not guaranteed, so the national level special "students' small table food safety supervision and management" legislation should be published as soon as possible in the legislation "small table" food safety. Three legal protection mechanisms including advance mechanism of prevention, middle mechanism of supervision and administration, later mechanism of reward and punishment and appropriate specific system should be designed. We must strengthen the "small table" operator law publicity and education, strengthen the "small table" food safety government daily supervision, improve the "small table" food safety awareness and legal rights the ability of students and their parents as well as strengthen the "small table" food safety connnunity monitoring mechanisms to make sure the entire mechanism to be effective.
