党委领导政法工作法治化的路径选择——以党委政法委功能定位为视角

Path Selection of Party leadership political and legal work:Function of Party committee and law as the angle of view

中国特色的政法体制既不同于传统礼法文化下的"行政兼理司法",也不同于以分权与制衡为重要标志的西方政治司法模式。政法体制,究其本源是在"救亡图存"和"富强民主"的双重历史诉求下杂糅马列主义、传统治理模式、现代西方法治元素以及中共革命经验而形成的独特社会治理模式,并据此形成制度载体"党委政法委"。在建设法治中国的时代下,关于党委政法委制度的讨论往往裹挟着意识形态纷争、司法体制改革需求以及司法权威重构的现实困境。笔者认为,党委政法委工作方式的法治化、职责边界的清晰化、服务司法权独立行使的职能化,才是其"长期坚持"的法治化路径选择。

Political and legal system, study the origin is in the double historical appeal of ＂saving the nation from subjugation＂ and ＂a prosperous, strong, democratic,＂ hybridity of Marxism Leninism, traditional management mode, modern western legal elements and Communist revolutionary experience and the formation of the unique mode of social governance, and accordingly formed system carrier ＂party politics and Law Committee＂ . In the era of construction of rule of law in China, discussion about party politics and Law Committee system often coerced the ideological disputes, judicial system needs to reform and reconstruction of judicial authority dilemma. In this paper, the rule of law, the clear definition of responsibility boundary, and the function of the independent exercise of the right to serve the judicial committee is the legal path choice of ＂long -term adherence＂.
