摘要
建国以来 ,为保护女职工生育期劳动权益 ,我国制定、颁布和实施了一系列相关的法律、法规 ,构成了较完整的保护网。值得警惕的是 ,由于种种原因 ,转型期女职工生育期劳动权益没有得到应有的保护 ,女职工生育期劳动权利的被剥夺、产假工资水平的下降、生育医疗保障不足等是其权益被损害的集中表现。政府应加大干预力度 ,设立保护妇女权益的专门机构或强化妇联的职能 ;加快《生育保险条例》制定步伐 ;对相关的政策规定进行清理 ,与《妇女权益保障法》相违背的或不利于保护妇女生育权益的条款 ,要加以纠正或取消 。
Since 1949, our government has made out , promulgated and enforced a series of corresponding laws and regulations , which has formed a complete protection net to protect the labor rights and interests of female staff during the fertility period However , during the course of transforming from the planned economy system to the market-oriented economy system the labor rights and interests of the female staff during the fertility period didn't get deserved protection , of which the concentrated expression are the deprived labor rights of the female staff during the fertility period , the decline of wages sum during the maternity leave and not enough fertility medical security etc The government should strengthen its interference , set up a special organization to protect the female rights and interests and strengthen the function of the Women's Federation ; and speed up the steps to make out a 《Regulations of Fertility Insurance 》, put the corresponding policies and regulations in order , adjust or even cancel those articles which are against the 《Protection Law of the Female Rights 》 or harmful to the female fertility rights and interests so as to entirely protect the female staff fertility rights and interests
