Renewed Understanding about the Methods of Awakening and Cultivating Judicial Conscience——Reading Chuanxilu

在王阳明的《传习录》中,良知有自在、自得和自律的特征。司法良知亦有自在人心的特点,只是由于特定原因会在特定时段进入休眠状态,但不会彻底消失,仍具有被唤醒的可能。司法良知的唤醒之道是司法人员的"慎独"和"精一",是在内心艰苦沉淀过程中的不断扪心自问和在具体案件面前的心无恶念,而且是不假外力的自我唤醒。

According to Wang Yangming＇s Chuanxilu,the conscience has the characteristics of self-existing,self-attaining and self-controlling,so the judicial conscience also exists naturally in the hearts of judges. The judicial conscience becomes dormant in certain periods only because of specific reasons,but it never to be disappeared and probably to be awakened. The methods of awakening and cultivating judicial conscience are the restraining in privacy and the single minded,which also continuously laying the hand on the heart and examining oneself in the process of intrinsic deposit,no evil in real cases,and self awakening not resorting to the external force.
