摘要
自上海自贸区设立以来,各界的关注点多集中在外资准入、人民币国际化、金融自由化等金融改革问题上,对自贸区内房屋租赁这样基础的法律问题却甚少研究。然而,作为自贸区企业进区的前置性问题,房屋租赁问题如果没有得到妥善处理,将会给自贸区的试运行增加难度,带来风险。基于此,文章结合自贸区设立以来的现状,通过对当下区内房屋的租赁情况、多重租赁关系、情势变更的适用、资本认缴制对合同履行的影响,以及法院送达等几个方面展开研究,并提出相关应对的建议,以更好巩固自贸区内的基础环节。
Since the establishment of Shanghai FTZ, people in different fields focus on the admittance of foreign capital, the internationalization of the RMB, financial liberalization and other financial reforms, while put less eyes on the basic legal issues on the house rental in FTZ. However, as a prepositive issue of the enterprises admitting into FTA, if rental issues haven't been properly handled, it will increase difficulties and bring about risks to the experiment of FTZ. Therefore, based on the current situation of Shanghai FTA since established, this paper analyzes the rental situation, circumstances, effect of subscription capital system on multiple rental relationship, application of change of the contract performance, and delivery of legal papers from the court, and propose several suggestions, in order to better consolidate the basic step of FTZ.
