摘要
随着"依法治国"战略的实施,中国法治化进程也逐步向前推进。在此背景下,中国地方省市逐渐出现了公众参与立法的现象,这不仅从实践层面提高了地方政府的立法质量,实现"立法型"法治到"实施型"法治的转变,而且有利于加快我国的民主化进程。尤其是地方法制建设中公众参与的协商民主特色,从根本上有利于提高公民的公共意识,实现其民主权利,同时也有利于缓解法治与民主之间的张力。
With the implementation of the strategy of governing the country according to law,the process of legalization is moving forward in China gradually. Under this background,the phenomenon of public in legislation has been found in some provinces. This kind of participation can practically improve the quality of legislation of local government,realize the transition from law legislation to law implementation,and speed up the process of democratization in China. Especially,the deliberative democracy characteristic of the public participation in the construction of local legal system can enhance the public awareness of citizens fundamentally,and realize their democratic rights. What is more,it can ease the tension between rule of law and democracy.
