中日刑事强制医疗程序比较研究

Procedure Comparison of Criminal Compulsory Medical Treatment in China and Japan

2012年《刑事诉讼法》设立了"依法不负刑事责任的精神病人的强制医疗程序",填补了有关涉嫌犯罪的精神病人处遇制度的空白。但无论是法典还是司法解释对于该程序的规定过于原则,可操作性不强,需要进一步地补充和完善。而日本已经建立了相对完善的刑事强制医疗程序及配套制度与设施,并积累了立法与实践经验。因此,有必要采取比较法学的研究方法,研究、分析日本刑事强制医疗程序立法中值得我们借鉴与吸收的价值与制度,以期完善我国刑事强制医疗程序。

In 2012, Criminal Procedural Law established ＂compulsory medical treatment procedure for psychopaths who do not bear criminal responsibility＂, which filled up the institutional blank of suspected psychopathic criminals. However,both the code and judicial interpretation are rather rigid and of bad operability, which need further supplement and perfection. Japan has set up a fairly perfect system and facility of criminial compulsory medical treatment and accumulated a lot of legislative and practical experience. Therefore,we use comparative jurisprudence to study and borrow the worth and system of Japan for our reference to perfect the procedure of criminal compulsory medical treatment in China.
