行政契约、行政协议和行政合同的辨析

How to Discriminate the Administrative Soul Contract,the Administrative Agreement and the Administrative Contract

随着行政契约在实践中广泛应用,我国学者对行政合同问题的相关理论研究也在逐步深入。通过查阅众多的相关文献资料,不难发现我国关于行政契约、行政协议、行政合同这三个词语存在着不同程度的混用状况,但是我国学者对于此问题的关注度明显不够,类似于摘要中的有意混用,粗看感觉并无障碍,但是在实际的操作层面人为增加了工作的复杂程度。随着我国行政协议立法工作和实际行政法务工作逐步拓宽深化,对于此三者做基本范围概念的辨析有着十分重大的现实必要性。

As the administrative contract is widely used in practice,Chinese scholars have gradually went deeper into the researches with respect to the theory of administrative contracts.After a review of many relevant documents,it can be easily found that in China the administrative soul contracts,the administrative agreements and the administrative contracts are somewhat confused.Obviously Chinese scholars paid insufficient attention to this issue.The intentional abuse of the three terms in the abstracts seem to be nothing serious at first sight but in reality the complexity of work is increased.As the Chinese legislative work of administrative contracts and practical work are gradually deepened,it is of great realistic significance to discriminate the basic scope of the concept of the three terms.
