专利法第四次修订中的两个重要问题

Two Important Issues in the Fourth Revision of Patent Law

《专利法修订草案(送审稿)》在加强专利权的保护和促进科技成果的运用方面有诸多亮点,但在总体思路方面有两个重要的问题还需进一步探讨:一是外观设计保护制度的单独立法;二是专利行政管理机关的职能定位。外观设计具有与发明明显不同的特性,单独立法保护更科学;加大保护力度、有效遏制侵权行为的措施,重点在于完善侵权救济措施、合理分配举证责任、加重损害赔偿责任,而不是通过增加专利行政机关的职能和加大其行政执法权来实现。

The Revised Draft Patent Law for examination made some progress in strengthening patent protection and promoting the patent exploitation and implementation. However, there are two important issues still short of fer discussion within the general framework of the revised draft law. One is independent legislation of industrial design patent; the other is the role definition of patent administrative management department. Industrial design has distinctive characteristics from invention, it is therefore more reasonable to carry out separate legislation for it. As to strengthen patent protection and stop infringing behavior, it is more reliable to adopt measures like improving infringement remedy, reasonably allocating burden of proof and enhancing obligation for damages than expanding administrative enforcement power ofpatent administrative organs by adding more functions to it.
