广东禁毒法制建设和法律适用存在的问题与对策——以粤东地区制毒犯罪严打整治为视角

以制毒犯罪严打整治为视角,当前广东禁毒法制建设方面存在立法滞后,行政执法低效和刑事司法水平不高等问题;在具体法律适用方面则存在毒品的认定,鉴定不规范,技侦证据转化待规制,制毒案件死刑适用要适应形势等问题。为此,要革新禁毒法制理念,立足创新,重视禁毒法制人才的培养,完善省级和地市级禁毒立法体制,建立禁毒法制保障和监督机制,促进禁毒法制建设工作的社会化和专业化。

From the perspective of striking -hard campaign against drug crimes, this paper discusses the problems existing in the construction of Guangdong＇s anti - drug laws, such as lag of legislation, efficiency of administrative law enforcement, low level of criminal justice and so on. The problems existing in concrete legal ap- plication include the determination of drugs, the non - standard of appraisal, the regulation of technical evidence transformation and the application of death penalty for drug - related crimes to the current situation. Therefore, the concept of anti - drug laws needs to be reformed on the basis of innovating, paying attention to the cultivation of anti - drug legal talents, improving the mechanism of provincial and municipal anti - drug legislation, establishing legal protection and supervision mechanism and accelerating the socialization and professionalization of anti - drug law construction.
