国际刑事法院介入非洲反政府武装问题的影响及限度——以乌干达圣灵抵抗军为例 被引量：4

摘要 对于非洲国家的弱势政府而言,面对反政府武装无力直接剿除;引入国际刑事法院进行干预,成为向反政府武装施加压力的手段。乌干达政府就是出于此目的,而将肆虐多年的圣灵抵抗军及其领导人告到国际刑事法院。不过,国际刑事法院对圣灵抵抗军主要领导人的起诉和逮捕令并没有实现他们预期想要的"公正",反而成为影响圣灵抵抗军与乌干达政府间和谈的一个主要障碍。这个案例的教训是,作为一个追求"公正"的国际司法机构,国际刑事法院的工作不能脱离乌干达实际情况,损害乌干达恢复和平的努力,而要立足现实,才能实现"公正"与"和平"的有机统一。
