近几年来，第三方融资在国际仲裁中崭露头角，并引起了很多讨论。第三方投资人的介入给国际仲裁程序带来很多挑战，从仲裁程序的保密性到仲裁员与投资人之间潜在的利益冲突，从仲裁费用的分担到裁决最终的可执行性，这一系列问题都是国际仲裁的各方参与人需要讨论并指定规则规范的。本文将从投资人和被投资人的关系入手，首先介绍第三方融资常见的几种方式，其次分析TPF的介入给国际仲裁带来的挑战，最后从投资人的角度，探讨投资人在国际仲裁中应加强自我监管机制。

Third party funding remains to be a relative new but hot topic in International Arbitration in recent years. The appearance of third party funder in international arbitration proceeding has raised many challenges including the confidentiality of the arbitration proceeding, the potential conflict of interest between the arbitrator and the funder, the liability for cost and the enforcement of the arbitral award. These issues need to be addressed by all the participants of the internationalarbitration and therefore the behavior of the third party funder requires certain regulation. This article will begin with an illustration of common types of funding relationship, then analysis the challenges brought by third party funding, and finally to discuss the possible self-regulation from funder＇s perspective.
