摘要
磔刑作为汉代死刑中的一等,关于其行刑方式及与其他刑名的关系问题历来备受争议。从"磔"字的本义入手,可探究出磔刑是从宗教祭祀活动中演变而来,具体的行刑方式为割裂、肢解人的身体并悬挂于木进行示众。它与车裂、弃市、膊刑、凌迟等刑罚均有一定的区别,并非是同种刑罚。汉景帝进行刑制改革后,磔刑的适用范围明显减少,作为法定死刑消失于魏晋南北朝时期。
Zhe Punishment,as one of the capital punishments at Han Dynasty,about its how to execute and the relationship between it and other capital punishment,has been an issue.This article analyses the word ‘Zhe',and holds that this punishment evolved from religious sacrificial activities.This punishment lacerated and dismembered human's bodies,and hang them on pole to expose publicly.This punishment was different from the punishment of tearing aperson asunder by five carts,Qishi,Bo,and so on.After the punishment reform of Han Jing Di,the subject matter which Zhe punishment applied reduced.It was abolished from code at the Wei and Jin dynasties.
