摘要
继党的十八届四中全会通过的《中共中央关于全面推进依法治国若干重大问题的决定》提出要"探索建立检察机关提起公益诉讼制度"后,全国人大常委会授权最高人民检察院在我国部分地区开展公益诉讼试点工作,这就使检察机关在环境公益诉讼中的定位从支持起诉转变为提起诉讼。检察机关提起环境公益诉讼需要厘清诉权顺位、诉权范围以及程序限制等相关问题。同时,应当从加强能力建设、健全程序规范和建立监督机制等方面切实保障检察机关有效提起环境公益诉讼。
After the "decision" of the Fourth Plenary Session of the Party's Eighteen puts forward "to explore establishing public interest litigation system instituted by procuratorial organs",NPC standing committee authorized the supreme people's procuratorate to carry out the pilot work in some areas so that procuratorial organs positioning is changed from support prosecution to institute the proceeding.Environmental public interest litigation is sued by the procuratorates to need to clear litigation related issues such as order,scope of litigation and the program limit.To ensure the procuratorates to sue the environmental public interest litigation we should strengthen capacity building and improve the procedure and the establishment of supervision mechanism, etc.
