英国借贷众筹平台的法律规制及对我国的启示

On the Legal Regulation of Loan Crowd Funding Platforms in UK and Its Enlightenment to China

2014年4月英国正式颁布的众筹监管规则是世界上第一部涉及P2P领域的法律,其第二、三部分对借贷众筹平台作了详细的规定,要求借贷众筹平台遵守审慎性标准、客户资金规则、破产后平台的借款返还规定与法定义务、取消权、信息披露与报告、争端解决机制等相关规定,通过对这些规则的详细分析我们发现,英国FCA在立法时遵循的是适当性、过渡性、成本与效益性三大原则。审视我国借贷众筹的立法与现状,笔者认为可借鉴英国众筹监管规则,对我国借贷众筹立法加以完善。

The regulatory rules on crowd funding promulgated formally by British in April 2014 is the world＇s first law concerning the P2 P field.In its second and third part,there are detailed provisions of crowd funding platforms.Platforms are required to abide by provisions such as prudential standards,rules of customers＇ fund, provisions of returning of loan and legal obligations after the bankruptcy,the right to cancel,information disclosure and reporting,dispute solving mechanism and other relevant provisions.Through detailed analysis of the provisions,followed British FCA in the legislation are appropriate,transitional,the costs and benefits principles.Review of the legislation and the status quo of China＇s loan crowd funding,the author believes that the British supervision can be adopted to improve the legislation of our country＇s loan crowd funding.
