国外食品安全的刑法保护及其借鉴

Research on Foreign Criminal Law Regulations of Food Safety and Their Reference Significance

食品安全与人类生命健康息息相关,许多国家针对食品安全犯罪问题进行了有益的尝试与创新。但即使在食品安全制度相对健全的发达国家,食品安全问题也是时有发生,许多国家和地区都加大了对食品安全犯罪的打击力度。我国应树立消费者至上的食品安全法律控制理念,借鉴执行与国际接轨的食品安全规章制度,优化行政执法与刑事司法衔接机制,最终建立起完善的食品安全防控体系。

Food safety is closely related to human life and health. Many countries have carried on some attempts and innovation for food safety problem. Even in developed countries with the relatively sound system to guarantee the food safety,the problems still occur now and then. Many countries and areas strengthen the penalties for the crimes on food safety. Chinese government should harbor the concept in the food safety law that the consumer be given priority,and learn from other countries and carry on food safety regulations in line with international standards,and optimize the administrative law enforcement and criminal justice mechanisms,and establish the perfect food safety control system eventually.
