试论地方志的著作权保护

On the Protection of the Copyright of Chorography

地方志编纂具有涉及部门多、人员杂、耗时久的特点,易导致编纂工作权责划分不清晰,出版权利义务不明的现象,从而形成著作权属争议和著作权纠纷。研究、探讨地方志著作权保护问题,明确著作权主体,并根据作品类型保护不同情形下著作权权利享有者的利益,才能真正保护地方志这一特殊著作的权利人的利益。

Editing of chorography is time-consuming and involves many departments,various personnel,which easily leads to complexity of compiling duty and responsibility as well as uncertainty of publishing duty and right,directly resulting in debate over copyright and its owner. Therefore,it is necessary to study and explore the protection of the chorographical copyright,in specific,confirming its subject,protecting the copyright owner＇ s interest accordingly in various specific cases so as to really guarantee the obligee＇s right who owns the copyright of the special work,chorography.
