摘要
市场经济条件下,为了社会公共事业、社会基础设施建设的发展,以及实现宏观调控目的,政府的大规模集中采购行为变得越来越普遍。与个人采购相比,政府采购规模巨大,因而政府逐渐成为市场中最大的消费者。为保障国家财政资金的合理使用,保证采购产品的质量合格、价格合理,政府规定采购活动一般都要通过公开招投标等方式来确定供应商。而在实际的采购活动中,很多投标人为实现自身利益最大化,采取不良违规行为,致使采购人等相关主体遭受损失。为此,《中华人民共和国政府采购法》特别规定了投标人不良行为名单制度。但从总体上看,我国的政府采购不良行为记录管理制度仍落后于实践的发展,对于供应商监管的规定也有待完善。
Under the condition of market economy, in order to develop public utilities and social infrastructure, the government of the large-scale centralized purchasing behavior has become more and more common for the purpose of the implementation of macro-control. Compared with the individual purchase, government procurement is huge, so the government has gradually become the largest consumer market. For the rational use of the protection of national financial funds, guarantee the quality of procurement of qualified products, reasonable price, government procurement activities generally through public bidding and other ways to identify suppliers. But in the actual procurement activities, a lot of the bidder want to maximize their own interests, to take adverse violations, resulting in losses to the purchaser and other related subjects. Therefore, "government procurement law" published by the People's Republic of China bind the bad behavior of the list system. But generally speaking, China's government procurement bad behavior records management system is still lagging behind the development of practice, the provisions of the supplier regulation also needs to be improved.
