摘要
和谐作为对良好法律秩序的价值追求,贯穿我国近二十年的劳动法制历程,然而,对实现和谐的路径与方法存在着不同侧重。以静态和谐为目标,我国劳动立法曾对原有的劳动关系运行规则进行改造,但实际效果与和谐目标仍存在较大差距。《关于构建和谐劳动关系的意见》针对当下劳动关系存在的典型问题,在尊重既有法律框架的基础上,以动态和谐与正和博弈为目标,统一维权与维稳的逻辑关系,形成构建和谐劳动关系的新思路。
As a value pursuit of good law and order,the concept of harmony remains a thread running through the course of China's labor legal system for nearly 20 years. But the methods of and approaches to the achievement of harmony vary in their emphases. Aiming at a static harmony,our labor legislation once reformed the original operation rules of labor relationship. However,there was a large gap between the actual effect and the goal to achievement harmony. Addressing the typical problems existing in labor relationship and respecting the existing legal framework,Opinions on the Construction of Harmonious Labor Relationship,aiming for a dynamic harmony and a positive-sum game,forges a sound logical relationship between rights protection and maintaining stability and develops a new idea of building harmonious labor relationship.
